Welcome to Treasure Trek. These Terms of Use explain the rules for using our website and services. Please read them carefully.
1. Agreement to These Terms
These Terms of Use (the “Terms”) apply when you visit https://www.treasuretrek.club, create an Explorer account, take part in a treasure hunt or online puzzle adventure, or use any other part of Treasure Trek (together, the “Services”).
By using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
Competitions have their own rules. For The Final Five, the Official Competition Rules also apply. If these Terms and the Official Competition Rules disagree about a competition, the Official Competition Rules control.
2. Who We Are
Treasure Trek is operated by TAPAT Holdings, Inc, 890 W Heritage Park Blvd, Layton, Utah 84041 (“Treasure Trek,” “we,” “us,” or “our”).

3. Using the Services
You must be at least eighteen (18) years old to create an Explorer account or take part in a competition.
You agree to use the Services only for lawful purposes and in line with these Terms.
You are responsible for your own device, internet connection, and any fees charged by your internet or mobile provider.
Some Services may not be available in every country or region. Availability for The Final Five is described on the Eligibility page.
4. Explorer Accounts
To take part in an adventure, you create a free Treasure Trek Explorer account.
You agree to:
- Give accurate information when you register.
- Keep only one account.
- Keep your password private and secure.
- Tell us right away if you think someone else has used your account.
You are responsible for activity on your account.
We may refuse, suspend, or close an account that breaks these Terms, the Official Competition Rules, or the law.
5. Competitions and Prizes
The Final Five and other competitions are run under their own Official Competition Rules.
No purchase or payment is necessary to enter or win the main Final Five competition.
Competitions test personal skill. Outside help is not allowed unless a competition’s rules say otherwise.
Prizes depend on eligibility, verification, and the Official Competition Rules. Taking part does not guarantee a prize.
6. Optional Purchases and Side Quests
Treasure Trek may offer optional purchases, such as Side Quests. Optional purchases are never required to enter, qualify for, or win the main Final Five competition.
Side Quests and any other paid features are available only when we announce them. Each one has its own terms, which will be shown to you before you pay.
Prices are shown at checkout. Payments are handled by independent payment providers. We do not store full payment card numbers on our own servers.
Digital access that has been used cannot be returned.

Paid Side Quests must be separately reviewed and approved before they are offered.
7. Explorer’s Satchel and Digital Rewards
The Explorer’s Satchel keeps a record of eligible digital rewards that you earn through Treasure Trek adventures.
Digital rewards are not a bank account, a deposit, or a payment service. They are not money, and they do not earn interest.
Digital rewards have no cash value unless the rules of a specific adventure say so.
Digital rewards cannot be sold, traded, or transferred to another person.
You may not use digital rewards, or any other part of the Services, for wagering or betting.
8. Referrals
You may invite others to take part using your personal referral link.
Referral rewards, if any, are described in the Official Competition Rules. They are limited, and they are not guaranteed.
You may not refer yourself, create fake accounts, or try to manipulate referrals.
9. Fair Play and Prohibited Conduct
You agree not to:
- Use more than one account.
- Use another person’s identity or account.
- Share unreleased puzzle answers or secret game materials.
- Use bots, scripts, or other automated tools to play or to interfere with the Services.
- Try to change timers, scores, submissions, or server records.
- Look for or use software bugs or security weaknesses.
- Harass, threaten, or impersonate other people.
- Copy, scrape, or resell the Services or their content.
- Break the law or the rights of others.
We may investigate suspected misconduct. We may remove content, cancel results, and suspend or close accounts.
10. Your Submissions and Feedback
When you submit puzzle answers, your display name, or messages to us, you give us permission to use that information to run the Services. This includes keeping records, checking results, and announcing results as described in the Privacy Policy and the Official Competition Rules.
If you send us ideas or feedback, we may use them without paying you or giving you credit.
Choose a display name that does not include private information.
11. Our Content and Intellectual Property
Treasure Trek, The Final Five, and everything in the Services are owned by us or our licensors. This includes stories, puzzles, artwork, maps, characters, logos, designs, and software.
We give you a limited, personal, non-commercial permission to use the Services as intended.
You may not copy, share, sell, or build on our content without our written permission, except where the law allows.
The physical Treasure Trek coins and other collectible items are separate products and may have their own terms.
12. Links to Other Websites
The Services may link to other websites or services. We do not control them and are not responsible for them. Please read their terms and privacy policies.
13. Privacy
Our Privacy Policy explains how we collect and use personal information. By using the Services, you agree that we may handle your information as described there.
14. Disclaimers
The Services are provided “as is” and “as available.”
We work to keep the Services running well, but we cannot promise that they will always be available, secure, or free of errors.
To the extent the law allows, we do not make any promises, express or implied, about the Services, including promises about fitness for a particular purpose.
Nothing in these Terms removes rights that the law says cannot be removed.

15. Limits on Our Responsibility
To the extent the law allows, Treasure Trek and its owners, employees, and partners are not responsible for indirect, incidental, special, or consequential losses, or for loss of profits or data, that come from your use of the Services.
To the extent the law allows, our total responsibility to you for any claim related to the Services is limited to the greater of one hundred U.S. dollars ($100) or the amount you paid us for the Services in the twelve (12) months before the claim.
Nothing in these Terms limits responsibility that cannot legally be limited.

16. Your Responsibility to Us
You agree to be responsible for losses, claims, and costs that come from your breaking these Terms or the Official Competition Rules, or from your misuse of the Services, to the extent the law allows.

17. Suspension and Ending Your Account
You may stop using the Services at any time. To ask us to delete your account, contact us at paul@treasuretrek.club.
We may suspend or end your access if you break these Terms or the Official Competition Rules, if the law requires, or to protect the Services and other people.
Some information may be kept after your account ends, as described in the Privacy Policy.
If your account ends during a competition, you may lose the chance to take part or to receive a prize.
18. Changes
We may change the Services or these Terms. When we change these Terms, we will update the Last Updated date. If a change is important, we will tell you in a way the law requires.
If you keep using the Services after a change takes effect, you accept the updated Terms, as far as the law allows.
19. Governing Law and Disputes
These Terms are governed by the laws of the State of Utah, United States, without regard to conflict-of-law rules.
Before starting a legal action, you agree to contact us at paul@treasuretrek.club and to try in good faith to resolve the dispute for at least thirty (30) days.
Any dispute that is not resolved will be decided only in the state or federal courts located in the State of Utah, and you agree to the personal jurisdiction of those courts. You agree to bring claims only on an individual basis, and not as part of a class, group, or representative action.
Nothing in this section removes rights that the law of your home country says cannot be removed.

20. General
If any part of these Terms cannot be enforced, the rest still applies.
If we do not enforce a part of these Terms right away, we may still enforce it later.
You may not transfer your rights under these Terms to anyone else. We may transfer ours as part of a business change.
These Terms, together with the Privacy Policy, the Official Competition Rules, and any rules shown for a specific feature, are the whole agreement between you and us about the Services.
